The problem of corruption in Kazakhstan

President of the Republic
of Kazakhstan Nursultan Nazarbayev declared a holy war on corruption at all
levels of government and society. The President put the subject firmly,
speaking at the Political Council and the XVI Congress of the Party "Nur
Otan", the board of the Prosecutor General's Office of Kazakhstan.
I think corruption
in Kazakhstan is a significant problem for economic and political development
of the country, is a threat to its national security.
Fighting corruption
in Kazakhstan is not the first year. Completely eradicate corruption is
impossible, but to reduce its level are quite capable of any State. Provided
that this work will be carried out systematically, rather than on a case by
case basis.
The Concept of
Legal Policy of the Republic of Kazakhstan, approved by President Nazarbayev
(02.09.2002g.), Laid concrete basis for further improvement and development of
the whole complex of existing legislation, including anti-corruption.
However, the government of our country, in the
five years that have passed since the adoption of the Concept of Legal Policy,
no real and effective measures for the improvement and development of existing
anti-corruption legislation actually been taken.
The problem of the
fight against corruption is one of the important in our society and the state
at the present stage. Corruption corrupts and undermines the foundations of the
state from within, negates all undertakings honest people willing to put your
heart and soul to the service for the benefit and prosperity of our nation and
fatherland. To increase the effectiveness of the fight against corruption is
necessary to activate the Set of political, legal and moral order, we need an
active life and the political will of all the people of Kazakhstan, focused on
the creation of an atmosphere in society that was burning under their feet
corrupt the earth! And only then can we expect some positive results. The
current state of the same fight against corruption is poor. It is not enough to
effectively engage and work with us legal mechanism to combat corruption, hence
such penalties for corruption offenses. One of the most effective instruments
to combat corruption offenses - it's a tough criminal-legal struggle with
corruption offenses. Criminal law provides for liability for various corruption
offenses, not fully and clearly defines the range of issues related to the
commission of offenses of corruption in our country. It should be improved,
taking into account the positive experience of the criminal law-foreign countries.
It is necessary to
tighten sanctions articles on corruption in law to make penalties for crimes
against the state more severe and, therefore, is not only fair and inevitable,
but also daunting. And even the small size should not be an excuse for such an
act. Personally, I think that there should be a mandatory confiscation of all
property, without the right to continue this activity in the future and
imprisonment without possibility of parole (offer many years).
It is now necessary
administrative and legal regulation of performance of civil servants that are
linked to corruption risks. I believe it is necessary to adopt an approximate
Registry civil service positions (civil, law enforcement, military) that are
associated with an increased risk of corruption - strengthening administrative
control over employees that override these positions make scheduled and
unscheduled rotation of personnel.
To reduce the
statistics on the number of corrupt officials, it is necessary to eradicate it
in the ranks of civil servants of the Republic of Kazakhstan. At the same time,
to create conditions to promote the work of civil servants to avoid extortion
and bribery.
In the law "On
State Service" should make changes and additions relating to more stringent
requirements for the selection of personnel for work in the public service:
1. All civil
servants - to commit, if the employee will be seen, or convicted of corruption,
he and his family will be denied the opportunity to participate in all state
programs.
2. Annual
inspection of all close relatives of movable and immovable assets (savings
banks, and so on. D.). Check carefully what a way to earn and whether
legitimate grounds.
3. Rotation of
civil servants every 5 years (not teams).
4. Optimization of the central
offices of the state, as a method of combating corruption.
5. Create a database of who was
involved in corruption.
6. Create a database of corrupt
people.
Number of civil servants
should be brought into line with the mandate entrusted to one or another
executive body. Secure the legal and administrative mechanisms for the use of
personnel reserve and rotation in a single system of civil service of
Kazakhstan.
In order to
strengthen the rule of law in the public service to develop the law "On
disciplinary responsibility of civil servants", which will contribute to
the improvement of disciplinary practices in the public service, and thus - the
formation of administrative-legal regime, prevent and combat corruption in the
public service.
Corrupt us - wealthy people
occupying high positions with good salaries and debt service have more
privileges! - Ashamed and sorry for the state! At corrupt completely absent
good human trait, as the conscience!
The higher the position held,
the decency, education, culture and industry have to be higher to that obliges
training (if any!).
Corrupt, bribe-taker - a person
is not educated, and education is laid in the family.
Mannered,
educated, cultured and self-respecting man, before taking a bribe in the first
place to think about yourself (authority), his family, and he is unlikely to
take such a step. For him it is a psychological barrier - a taboo!
Conclusion: To appoint to
senior positions educated people, which means decent, honest, principled,
hardworking and educated! That, unfortunately, is not done.
I speak - I suggest, for 20
years, to develop a concept at the state level, "On the education of the citizen
of the Republic of Kazakhstan", which should be specified functions of all
ministries and departments, as well as the status, rights and duties of the
child (depending on age) and parents (benefits, responsibilities, promotion,
punishment).
